Terms for AeroNyx official services and protocol participation, including user content responsibility, permissionless nodes, acceptable use, IP policy, third-party services, and Wyoming law.

AeroNyx Terms of Service

Effective date: July 6, 2026

These Terms of Service govern your access to and use of AeroNyx websites, documentation, applications, APIs, Nodeboard, AeroNyx Privacy Network, encrypted messaging features, MemChain, developer tools, and related services that link to these terms.

By accessing or using AeroNyx, you agree to these terms. If you do not agree, do not use AeroNyx.

These terms incorporate by reference the following AeroNyx policies, as applicable to your use:

If a product-specific, repository-specific, event-specific, or service-specific agreement conflicts with these terms, the more specific agreement controls for that product, repository, event, or service.

1. What AeroNyx Is

AeroNyx is an open privacy protocol and product ecosystem designed to help humans, applications, and autonomous agents route traffic, exchange encrypted messages, preserve private memory, and coordinate work through blind, open infrastructure. These terms distinguish between AeroNyx-operated services, open protocol nodes, user-controlled content, and third-party services.

AeroNyx products may include:

  • AeroNyx Privacy Network for private encrypted routing
  • encrypted messaging and relay services
  • MemChain and node-blind encrypted storage
  • Nodeboard for decentralized node operations
  • protocol APIs, SDKs, documentation, and developer tooling
  • public protocol statistics and network transparency pages

AeroNyx controls AeroNyx-operated services, such as official websites, apps, APIs, Nodeboard, documentation, support channels, discovery services, bootstrap lists, and public statistics. AeroNyx does not control every compatible protocol node, every independent node operator, every destination service, or every third-party provider unless a specific service says otherwise.

Some parts of the AeroNyx ecosystem may be open source. Open-source code, protocol documentation, examples, brand assets, interface files, SDKs, and other materials are governed by the license or usage notice in the applicable repository, page, package, or asset. If no license is provided, AeroNyx reserves all rights to that material.

2. Eligibility

You must be at least 13 years old to use AeroNyx. If you are under the age of majority where you live, you may use AeroNyx only with permission from a parent or legal guardian.

You may not use AeroNyx if applicable law prohibits you from doing so.

3. User Responsibilities

You are responsible for:

  • complying with all laws that apply to your use of AeroNyx
  • securing your devices, accounts, credentials, wallets, recovery phrases, and private keys
  • maintaining backups of keys and recovery information
  • all activity that occurs through your account, device, node, wallet, or API credentials
  • reviewing third-party terms before using third-party services through AeroNyx

AeroNyx cannot recover lost private keys, seed phrases, encrypted memory keys, or self-custody credentials.

You are solely responsible for all content, data, messages, files, traffic, commands, prompts, memories, and other materials that you create, send, store, publish, route, relay, or make available through AeroNyx.

AeroNyx does not claim ownership of your content. However, you represent that you have the rights and legal authority required to use, transmit, store, or route that content through AeroNyx.

Because AeroNyx Privacy Network, encrypted messaging, relay, and MemChain features are designed so AeroNyx-operated services cannot decrypt or access user plaintext protected by user-held keys, AeroNyx generally cannot know what is inside those encrypted payloads. You remain legally responsible for your own encrypted and unencrypted activity, even when AeroNyx cannot read the content.

AeroNyx's inability to decrypt encrypted content is not permission to misuse the service. AeroNyx may investigate, restrict, suspend, preserve, disclose, or otherwise act on information it can access, including account data, node metadata, public content, plaintext support communications, abuse reports, payment records, security signals, and information required by lawful requests.

You agree not to use AeroNyx to send, store, route, relay, or coordinate content or activity that is illegal, harmful, abusive, infringing, exploitative, or otherwise prohibited by these terms or applicable law.

5. Acceptable Use

In summary, you may not use AeroNyx to violate law, harm others, exploit minors, distribute malware or phishing, attack infrastructure, bypass security controls, deanonymize users, manipulate node or route data, infringe rights, impersonate AeroNyx, or create legal, security, abuse, privacy, trust, or operational risk.

You remain legally responsible for content, traffic, messages, files, memories, prompts, requests, commands, node advertisements, and other activity that you create, send, store, route, relay, publish, or cause to be processed through AeroNyx.

AeroNyx does not weaken encryption, require secret backdoors, or inspect encrypted payload plaintext to enforce acceptable use. Enforcement is based on information AeroNyx can lawfully access, such as user reports, service records, node metadata, route proofs, public information, security events, and valid legal requests.

6. Open Protocol and Permissionless Nodes

AeroNyx is designed as an open privacy protocol. Unless a specific hosted service says otherwise, any person or organization may run compatible AeroNyx protocol nodes, subject to applicable law, technical compatibility, security requirements, hosting rules, and their own infrastructure responsibilities.

Running a node does not mean that AeroNyx has approved, certified, endorsed, supervised, or taken responsibility for that node. Independent node operators are not automatically agents, employees, partners, franchisees, contractors, or representatives of AeroNyx.

AeroNyx-operated apps, Nodeboard, bootstrap lists, discovery services, public statistics, or routing surfaces may apply health checks, compatibility checks, abuse-prevention rules, allow lists, deny lists, capacity filters, or quality criteria before displaying, ranking, selecting, or routing to a node. These controls are intended to protect users and protocol health; they do not make independent nodes AeroNyx-operated nodes.

Independent node operators are responsible for their own nodes, including security, uptime, lawful operation, hosting terms, user-facing disclosures, taxes, licenses, abuse handling, local logging or retention obligations, and compliance with any laws that apply to their operation.

If you run or manage an AeroNyx-compatible node through AeroNyx-operated services, you must also follow the AeroNyx Node Operator Policy: https://docs.aeronyx.network/articles/aeronyx-node-operator-policy.

AeroNyx does not guarantee:

  • uninterrupted availability
  • a specific route, region, speed, latency, or capacity
  • that every protocol node is operated by AeroNyx
  • that every independent node will be displayed, selected, or routed to by AeroNyx-operated services
  • that use of the network provides perfect anonymity
  • that the service is lawful for every use case in every jurisdiction

You are responsible for using privacy network features lawfully in every jurisdiction that applies to your activity. AeroNyx is a privacy infrastructure project, not a permission to violate laws, evade responsibility, or infringe third-party rights.

7. Node Operators and Nodeboard

If you operate an AeroNyx node or use Nodeboard, you agree to:

  • provide accurate public endpoint, capability, region, and health information
  • keep your node secure and updated
  • comply with applicable hosting, network, data, export, and local laws
  • avoid logging or attempting to inspect user content; any logging beyond protocol-required operational metadata must be legally required or clearly disclosed, and must not be represented as AeroNyx's default privacy model
  • avoid manipulating capacity, route, proof, or health information
  • use administrative commands responsibly

Nodeboard may provide restart, upgrade, maintenance, audit, incident, health, and capacity features. Administrative actions may be logged for security and accountability.

8. Encrypted Messaging, Relays, and MemChain

AeroNyx may provide encrypted messaging, relay, and node-blind memory features. These systems are designed so that AeroNyx-operated relays and storage services cannot decrypt, access, or parse user plaintext protected by user-held keys, while still processing the limited routing or storage metadata required to deliver the service.

You are responsible for:

  • the content you create, send, store, route, relay, or make available through AeroNyx
  • backing up keys and recovery credentials
  • choosing whether to use external AI model providers
  • understanding that encrypted data may be unrecoverable if you lose keys

If you connect an external model, RPC provider, payment provider, storage provider, app store, node operator, or other third-party service, that service's own terms, policies, and legal obligations apply.

9. Fees, Payments, and Taxes

Some AeroNyx features may be free, paid, usage-based, token-gated, or subject to subscription terms. If you purchase a paid feature, you agree to pay applicable fees and taxes. Fees may change with notice where required by law.

Unless a separate refund policy applies, payments are non-refundable to the extent permitted by law.

10. Intellectual Property

AeroNyx, including its names, logos, websites, product designs, documentation, and non-open-source software, is protected by intellectual property laws.

Subject to these terms, AeroNyx grants you a limited, non-exclusive, non-transferable, revocable license to use AeroNyx products for their intended purpose.

Open-source components are licensed under their respective open-source licenses. Nothing in these terms limits rights granted under an open-source license.

You may not use AeroNyx marks in a way that falsely suggests affiliation, endorsement, certification, sponsorship, or official status. You also may not remove, obscure, or alter AeroNyx copyright, license, attribution, or security notices.

11. Feedback

If you provide ideas, bug reports, feature requests, or other feedback, you grant AeroNyx permission to use that feedback without restriction or compensation, unless we separately agree otherwise in writing.

AeroNyx may link to, reference, display, route through, or integrate with third-party content and services, including model providers, RPC providers, payment processors, hosting providers, app stores, analytics tools, decentralized infrastructure, destination websites, independent node operators, community tools, developer libraries, and ecosystem applications.

Third-party content, tools, links, nodes, applications, opinions, statistics, and services are the responsibility of the person or entity that provides them. Unless AeroNyx expressly says otherwise, they do not represent AeroNyx's views, endorsement, certification, supervision, or control.

AeroNyx is not responsible for third-party services, content, policies, security, privacy practices, uptime, legality, accuracy, or availability. If you access or use third-party services, you do so at your own risk and subject to their terms and policies.

13. Protocol Information and Reliance

AeroNyx documentation, public statistics, dashboards, examples, guides, website content, protocol explanations, node information, and developer materials are provided for general informational and operational purposes.

AeroNyx does not warrant that public information is complete, current, accurate, available, secure, error-free, or suitable for your specific purpose. Protocols, software, nodes, routing conditions, public statistics, and third-party services can change quickly.

You rely on AeroNyx information, documentation, dashboards, examples, and public statistics at your own risk. You are responsible for independently evaluating technical, legal, security, operational, financial, and compliance risks before using, integrating, operating, or relying on AeroNyx.

Nothing in AeroNyx documentation, public statistics, websites, dashboards, or AI-generated output is legal, financial, investment, tax, medical, or other professional advice.

14. No Emergency Use

AeroNyx is not designed for emergency communications or safety-critical systems. Do not rely on AeroNyx where failure could lead to death, personal injury, severe property damage, or critical operational harm.

15. Disclaimers

AeroNyx is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, AeroNyx disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, security, and error-free operation.

No privacy, security, routing, encryption, or node-discovery technology can guarantee absolute anonymity, confidentiality, availability, censorship resistance, legality, performance, or protection against every threat.

16. Limitation of Liability

To the maximum extent permitted by law, AeroNyx and its affiliates, developers, contributors, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, keys, funds, or business opportunities.

To the maximum extent permitted by law, AeroNyx's total liability for all claims relating to the services will not exceed the greater of: (a) the amount you paid to AeroNyx for the service giving rise to the claim in the twelve months before the claim, or (b) USD $100.

Some jurisdictions do not allow certain limitations. In those jurisdictions, limitations apply only to the extent permitted by law.

17. Indemnity

You agree to defend, indemnify, and hold harmless AeroNyx and its affiliates, developers, contributors, officers, employees, contractors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your use of AeroNyx, your content, your node operation, your violation of these terms, or your violation of law or third-party rights.

18. Suspension and Termination

We may suspend, restrict, or terminate access to AeroNyx if we believe:

  • you violated these terms
  • your use creates legal, security, abuse, or operational risk
  • we are required to do so by law
  • continued service operation is not commercially or technically feasible

You may stop using AeroNyx at any time. Some provisions of these terms will survive termination, including intellectual property, disclaimers, limitation of liability, indemnity, dispute, and general provisions.

19. Changes to AeroNyx and These Terms

We may change, suspend, or discontinue features at any time. We may update these terms from time to time. If changes are material, we will provide notice through the website, app, documentation, or other reasonable channels. Continued use after changes become effective means you accept the updated terms.

20. Geographic Restrictions and Local Compliance

AeroNyx is based in Wyoming, United States. AeroNyx makes no claim that every AeroNyx-operated service, protocol feature, node route, documentation page, download, integration, or third-party service is lawful, accessible, or appropriate in every jurisdiction.

If you access, use, operate, integrate, or route through AeroNyx from outside Wyoming or the United States, you do so on your own initiative and are responsible for compliance with local laws, regulations, sanctions, export controls, telecommunications rules, data protection rules, hosting rules, and any other obligations that apply to your activity.

AeroNyx may restrict access, features, routing, node visibility, or service availability where we believe legal, security, abuse, operational, or compliance risk requires it.

21. Governing Law and Disputes

These terms are governed by applicable United States law and the laws of the State of Wyoming, without regard to conflict-of-law rules, unless mandatory law requires otherwise.

Unless mandatory law requires a different venue, disputes will be resolved in the state or federal courts located in Wyoming.
